Article 3: Access Conditions

Users declare they are able to accept these TOU and are not under legal protection (guardianship, curatorship). Access to the application requires compatible equipment (computer, smartphone, or tablet) and an Internet connection to import, share and back up texts. Texts stay on the phone and rehearsal works without a network in the mobile application. We recommend downloading and installing the Android or iOS application. Premium versions are paid according to indicated rates. All equipment, software, or Internet subscription costs are the user's responsibility. To use SYNQRO, users must create an account by providing an email address and password and accepting the TOU. When subscribing to a paid plan, users must make an online payment. DEVPARTNER will send an email confirmation marking the start of the subscription.

Article 4: Subscriptions, Rates, and Payment

Paid plan rates are indicated in euros, including all taxes, and may be modified. Current prices are: SYNQRO PRO at €2.49 per month, €12.99 for 6 months or €19.99 per year, and SYNQRO TROUPE from €9.99 per month, €49.99 for 6 months or €69.99 per year for 5 members. The SYNQRO AMATEUR / BASIC plan is no longer sold to new subscribers but remains active for existing subscribers while their subscription is valid. SYNQRO PRO and SYNQRO TROUPE may be offered as 7-day free trials, one per account (and per troupe for SYNQRO TROUPE), under Article 4 of the Terms of Sale. These trials may be limited to specific flows or periods and do not guarantee permanent availability. Any rate changes will apply to the next subscription. VAT changes or new taxes will be reflected in subscription prices. Connection fees or international payment charges are not covered by DEVPARTNER. DEVPARTNER will strive to maintain its rates as low as possible. During events, DEVPARTNER may offer promotional codes and will notify users via its website and social media. Users are responsible for correct use of discount codes, and no refunds will be given in case of error. 4.3 Referrals, promotional rewards and contests

SYNQRO may offer referral programs, promotional rewards or contests. The terms specific to each operation, including duration, qualification criteria, rewards, winner selection method and personal data rules, are specified in the dedicated terms or rules available from the application.

A referred user can only be attached to one referrer. Unless stated otherwise in the specific terms, existing accounts, self-referrals, fake, duplicated, automated or artificially created accounts do not allow a reward to be obtained.

SYNQRO may perform proportionate checks to prevent abuse and temporarily suspend reward attribution when serious fraud indicators exist. A definitively earned reward remains due, subject to later established fraud.

Acceptance of the Terms of Use or contest rules does not constitute consent to receive marketing communications.

Each subscription does not commit the user; they can cancel their subscription at any time. All this is managed securely through our provider STRIPE, who handles payments, subscriptions, and refunds.

4.1 Subscription Withdrawal In accordance with Article L121-21-8 of the Consumer Code, Users acknowledge and accept that Application provision begins immediately after registration validation with DEVPARTNER or any intermediary, before the end of the 14-day cooling-off period provided by consumer law, and consequently acknowledge and accept not benefiting from the right of withdrawal related to online or distance selling. Therefore, no withdrawal, cancellation, or refund requests will be accepted for the subscribed period.

4.2 Renewal and Cancellation Users with a Premium subscription will have their subscription automatically renewed at the end of each chosen period (month, 6 months or year). They can cancel it at any time from Settings › My subscription, which opens the Stripe portal. Cancellation will take effect at the end of the current period and will be charged for the current period.

Article 5: Contract Resolution

In case of non-payment by the User, the contract may be terminated at the injured party's initiative. It is expressly agreed that this termination for breach of obligations will occur automatically 8 days after sending a formal notice that remains partially or totally without effect. The formal notice will be sent by email to the address associated with the User account and will mention the intention to apply this clause. Regarding SYNQRO premium plans: In case of advantage taken from a bug detected by DEVPARTNER, termination may occur by right, eight days after a formal notice sent by email remains without effect. In this case, access to the premium plan will be suspended without refund or compensation. The formal notice will be sent to the User account address and will mention the intention to apply this clause.

Article 6: SYNQRO Library

The SYNQRO application provides Users with a database of learning texts in the Our Texts/Our Library section, where Users can choose texts to work on. These texts, identified as "Public Domain," benefit from moral rights protection in France, although their economic rights have expired.

Article 7: User Responsibility

The application allows Users to upload their own content for working on learning texts. Users are solely responsible for the content they upload and must ensure compliance with applicable copyright laws. If Users are the content authors, they grant DEVPARTNER a free license to use this content within the framework of SYNQRO application services. This license covers reproduction, representation, and digitization of this content to provide the services requested by Users. DEVPARTNER reserves the right to technically modify this content to ensure compatibility with the application. Users are informed that DEVPARTNER is not responsible for content they upload or share, nor for any resulting third-party rights violations. In case of illegal content or infringement of third-party rights, DEVPARTNER reserves the right to delete such content, deactivate the User's account, and inform competent authorities.

Article 8 – Text Import and SYNQRO Formatting

To ensure optimal application performance, any content uploaded by the User must comply with SYNQRO’s formatting guidelines. The system automatically attempts to convert uploaded files into plain text using the default import method. For PDF and TXT files, this conversion is performed by an internal Synqro-developed algorithm with no third-party services involved; photo import relies on the OCR.space service for character recognition. However, certain files (poorly structured PDFs, scans, non-standard encoding, etc.) may prevent proper conversion.
The User is responsible for the final formatting of their text. DEVPARTNER provides no guarantee regarding the accuracy or success of this automatic conversion.

Tools, FAQ resources, and dedicated support are available to help the User correctly format their text.

Article 9: Warranties and Responsibilities

DEVPARTNER cannot be held responsible for malfunctions related to access or use of the SYNQRO application, particularly due to the nature of the Internet, force majeure, or an obsolete User operating system (more than 3 years old). DEVPARTNER assumes no responsibility for compatibility issues related to User equipment or application modifications necessary for technical reasons. These adaptations protect both SYNQRO and DEVPARTNER while ensuring a legal framework for application and associated services use.

Article 10: Service Availability and Technical Information

The SYNQRO Application is accessible to registered users via www.synqro.app or can be downloaded from the Play Store or App Store. DEVPARTNER reserves the right to temporarily suspend access to the application for maintenance or updates. These interruptions will, when possible, be announced 24 hours in advance, except in emergencies. DEVPARTNER may also permanently close the Application without compensation, with 3 months' notice. Any subscription paid for a period beyond closure will be refunded for the unused duration.

Article 11: Clause Nullity and Applicable Law

If any clause in these TOU is deemed null or unenforceable, the other clauses shall remain in force unless contract execution becomes impossible without this provision. The TOU and Application are governed by French law, and the language of interpretation is French in case of dispute over term meaning.

Article 12: Disputes

In case of dispute relating to these TOU or Application use, and in the absence of amicable resolution, competent courts will decide. Users are informed that they may also resort to conventional mediation, particularly with the Consumer Mediation Commission, in accordance with Article L 612-1 of the Consumer Code. Thank you for using our application!
